Subject: We urge Congress to demand a stop to the deportations of Haitian migrants & and end to Title 42 expulsions!

Message:

The Biden administration has resumed deportation flights to Haiti as thousands of Haitian migrants desperately seek asylum at the U.S.-Mexico border. I am appalled that the Administration has chosen to deport people escaping political unrest, a devastating earthquake, and a recent tropical storm that has exacerbated already dire humanitarian conditions. The current situation at the camps at the Del Rio/Ciudad Acuña border is tragic and unacceptable. Almost 10,000 asylum seekers are currently stranded under a bridge in Del Rio, Texas. Many, including children, are in urgent need of medical attention. Deporting people to life-threatening situations is a clear violation of the 1951 Refugee Convention, the Convention on the Rights of the Child, other human rights laws, and our own commitments to refugees and asylum seekers. I am distressed that the Biden administration has continued to use the previous Administration's "border shutdown" rule -- the Title 42 health regulation -- to expel primarily Black and Indigenous people from the United States. A federal judge ruled last week that Title 42 is unlawful. On August 3, the Department of Homeland Security (DHS) acknowledged the precarious situation in Haiti and renewed Temporary Protected Status (TPS) for Haitians in the U.S. It is unconscionable and —contradictory — for the Biden administration to now ignore this crisis and resume deportations. It is an even more egregious violation of due process rights to refuse entry and deny asylum processing to asylum seekers at the border. Many asylum-seekers are not given a hearing before they are sent back to the terror and violence they fled, even though the U.S. has the responsibility to receive asylum claims and to provide refuge to migrants with credible claims. I urge you to demand President Biden and DHS Secretary Mayorkas stop expelling and deporting Haitian and other Black and Indigenous asylum-seekers. I would also urge that Congress demand an end to the deportations and expulsions under Title 42. We need to uphold our laws, ensure due process and protect human rights at our borders. These expulsions and deportations, the U.S. is reneging on its responsibilities and violating the rights of those already in vulnerable situations. Thank you for your immediate attention to this matter.

At one time you claimed this policy indefensible, giving signals that you were going to roll it back or end it all together. Now you have begun to embrace it to the detriment of human rights and due process at the border, making an already desperate situation even worse. I expect strong leadership on issues of human rights, due process and obligations under U.S. and international law. I strongly urge you, President Biden and Vice President Harris, to end the deportations of Haitians and asylum seekers at the U.S.-Mexico border and end Title 42. Thank you for your immediate attention to this urgent situation.
